Welp. I can assume we all agree that none of us saw this coming.
Elle Woods Reese Witherspoon and husband Jim Toth had a night out on the town in Atlanta on lat Thursday night that ended up with both of their asses arrested!
Atlanta PD pulled the couple over in the early hours of Friday morning, after cops spotted their car – a Ford Fusion – driving erratically. Toth was behind the wheel at the time, and when questioned by the the officer who pulled the stop, replied he’d only had one drink.
Problem is, he blew a .139 on the breathalyzer. According to Variety, things went down like so:
While Toth is facing a DUI charge after driving in the wrong lane, Witherspoon was also arrested on a disorderly conduct charge according to a police report obtained by Variety. She was handcuffed after disobeying repeated instruction from the arresting officer, with whom she verbally sparred, to stay inside the vehicle.
The couple was released on bond at approximately 3:30 a.m. ET on Friday.
CAA, which employs Toth and represents Witherspoon, and her publicist, Meredith O’Sullivan Wasson, declined comment.
A court appearance is scheduled for Monday at 8 a.m. in Atlanta Municipal Court, but Witherspoon and Toth aren’t expected to appear, according to sources. Their attorney is expected to request that court date be postponed.
Witherspoon, 37, was with Toth, 42, in Atlanta shooting indie drama “The Good Lie.” Production on the film was not interrupted by the arrests, according to sources.
Of course, TMZ givs us the goods on the ‘disorderly conduct’ from Reese, who pulled a “Do you know who I am?!” on the arresting officer.
As officers dealt with Jim, Reese allegedly started acting up, telling cops, ”Do you know my name?” The officer answered by saying, “No, I don’t need to know your name.”
Witherspoon then came back with, “You’re about to find out who I am … You are going to be on national news.”
During Jim’s arrest, Reese allegedly became ornery, demonstrating visual and verbal frustration over how long it was taking to arrest her husband. At one point, she got out of her car and the officer ordered her back inside. When she got out a second time, he arrested her for disorderly conduct, a municipal ordinance.
Reese has since issued a statement regarding her arrest, taking responsibility for being a drunken mess.
“Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that was no excuse. I was disrespectful to the officer who was just doing his job. The words I used that night definitely do not reflect who I am. I have nothing but respect for the police and I am very sorry for my behavior.”
The pair, who were initially supposed to appear in court today, have both had their cases continued for a later date. Currently, they’re scheduled for May 22 and 23.
